Introduction
We welcome you to enjoy the peace and beauty of the mountain and forest environment at Badaguish.
The Events and Outdoor Badaguish Hub is set amidst the superb forest and mountain scenery of the Cairngorms National Park in the Scottish Highlands. It is committed to Access for All and has a range of fully accessible and affordable accommodation and facilities that have been purposely designed to meet the needs of youth, education, community and family groups and to suit all budgets.
The site has a café events area, conference centre, training hall and sports arena and welcomes training courses, small functions and events, conferences and small wedding parties by arrangement.
The site has spacious fields with play areas, a rustic BBQ area, bike park, football pitch and superb access to mountain walks, cycling trails as well as the award-winning Loch Morlich beach nearby. Badaguish Events Venue – Terms & Conditions for Events
Please read both our Events Venue and Accommodation Terms and Conditions before booking to ensure Badaguish is the right place for the purpose of your visit.
Bookings
1. Bookings are at the discretion of the venue whose decision shall be final in all matters concerning the booking. Bookings will not be confirmed until a signed application has been received on the prescribed form and the specified security deposit paid. Receipt of deposit constitutes full agreement to all terms and conditions stated. You have to be at least 18 years old to make a booking.
2. A non-refundable deposit of 20% of the total booking fee will be required to secure the booking date. This includes all the pre-event management, visits, and liaison. This deposit is payable at time of booking. All remaining balance payments must be paid 45 days prior to your event date. Failure to do so will result in loss of reservation.
3. A security deposit is required to be pre-authorised on a credit card prior to arrival This amount is held against damage, breakages, disruption, violation of the noise curfew etc. In the unlikely event of any damage being done or the venue being left in an unsatisfactory condition, we reserve the right to impose a reasonable charge to return the venue to its prior condition. Should additional cleaning be necessary or extensive damage/loss occurs the hirer shall lose the returnable bond and further pay the venue the amount requested to make good.
4. The preferred method of payment is by BACS transfer, although we can accept cheques, credit card of debit card. Please contact us directly for bank details. For both payment types, please use your invoice number as the payment reference. Please note that credit card details via email cannot be accepted under any circumstances.
5. All prices are inclusive of VAT. However, if the rate of VAT changes between the date the contract is formed between you and us and the date of your event, we will adjust the VAT you pay (and hence the overall price of your event) unless you have already paid for your event in full before the change in the rate of VAT takes effect.
Cancellation
6. If you need to cancel a confirmed booking, you must do so in writing. In the event of a confirmed booking being cancelled the full deposit paid will be retained. In the event of a confirmed booking being cancelled by you within 45 days of the date of the event the full balance will be retained. We strongly recommend that you take out cancellation insurance to cover yourself in this eventuality.
7. If you fail to pay the outstanding balance by the 45-day deadline, we reserve the right to cancel the booking.
8. A change of date will be treated as a cancellation of your original booking. The creation of a new booking will be subject to the terms and conditions prevailing at that time.
9. Events out with our control (force majeure) - except as set out in this clause, we shall not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under our contract with you that is caused by events outside our reasonable control (such as serious damage to the venue, serious adverse weather conditions, a pandemic or epidemic, or interruption or failure of utility services such as electric power, gas or water). In these circumstances, we shall use every effort to notify you as soon as is reasonably practical and to move the dates of your event by agreement with you. If, as a result of such events, we believe we have no alternative but to cancel your booking, we shall use reasonable endeavours to help you find an alternative venue of a similar standard for a similar price but our sole liability to you shall be to refund you any money you have paid towards your event. Other Terms and Conditions
10. We will not under any circumstances accept responsibility or liability in respect of any damage to or loss of any goods, articles or personal property, or property of any kind brought into or left at the venue either by you, any of your guests, suppliers or by any other person or left or deposited with any of our officers or employees, except to the extent that such damage or loss is due to our negligence or wilful misconduct.
11. The Hirer is responsible for the actions and consequences of all their guests, employees and sub-contractors.
12. Your event shall be confined to the area/building specified in your booking.
13. The finishing time stated shall be the time when the function room(s) shall be cleared and the hirer’s guests vacate the venue, not when the function ceases. Badaguish has a low noise policy after 10pm, with no noise outside after 11pm. We reserve the right to conclude any function which, in our opinion, is unsuitable or not properly conducted. In such cases, no part of the payment shall be returned. We kindly ask your guests to keep noise levels at a respectable level when leaving the premises. Taxis and other transport should be arranged accordingly, prior to the event.
14. No part or whole of any booking may be sublet by the client without prior written permission.
15. The price of your event shall be as set out in our confirmation email. Any “extra” services not set out in this email which we subsequently agree at our discretion to provide to you will also be billed to you as and when such services are requested, and we agree in writing to supply them. We reserve the right to make an additional charge should there be any variation of an agreed time. Such variations will be agreed with you.
16. Confirmation of final numbers, menus, timings, special dietary requirements and all other details are required at least 45 days before the event date unless a different timescale is mutually agreed. Charges will be based on these minimum numbers or if greater, the actual number of attendees. Your final balance payment will be based upon these details. We cannot guarantee to accept any changes thereafter and no amendment will result in a reduction of your final balance.
17. Any electrical equipment or appliances which the client proposes to use for the event requires a current Portable Appliance Test (PAT) Certificate. All stands, fittings and materials which the client proposes to use for the event must be fire-retardant in accordance with the appropriate legislation. We reserve the right to require the client to remove anything which is not appropriately certified or which it deems unsuitable, in its absolute discretion. The client will indemnify us against all actions, costs, claims and demands in respect of any breach of the provisions of this clause.
18. Marquees and tents shall not be supplied or erected without the prior written consent.
19. No bolts, nails, screws, tacks, drawing pins, or Sellotape shall be fixed to any part of the premises, nor shall any place cards, banners or smaller articles be fixed either internally or externally without the prior written consent.
20. We shall be the sole provider of all beverages at the event unless previously agreed in writing. If there are to be any pre-authorised self-service drinks, the client is required to complete a form detailing authorised drinks being provided by the client. Anyone providing pre-authorised beverages is required to hire glassware through us or pay a corkage fee. It will not be permitted for anyone to consume their own drinks at the event. We reserve the right to either withdraw our services or make an additional charge to cover our reasonable costs or losses in revenue if guests are found to be providing their own beverages. Bar opening times will be subject to approval by the relevant authorities. Our bar operates under The Licensing Act 2003. Our staff are instructed to operate within these rules. Please note the following - no alcohol will be sold to anyone under the age of 18, or who appears to be so and cannot prove otherwise. If your event includes guests around the age of 18, please ask them to bring ID. It is an offence to sell or supply alcohol to anyone under the age of 18. If we suspect that anyone is doing so, service from that person will be withdrawn. If we see any person we know to be underage drinking alcohol that has been purchased from us, we will confiscate the drink or ask you to do so. We will not serve anyone who is excessively drunk, or who is abusive or threatening to staff or other guests.
21. All drinks are paid for as sold on the night, with the exception of prepaid drinks packages or prepaid free bars. We do not offer credit or credit card facilities and will not run a tab type bar unless monies have been paid prior to the event or an agreement has been drawn up.
22. It is prohibited to use fireworks and Chinese lanterns on the premises, however, the use sparklers is allowed. The landing of aircraft such as hot air balloons or helicopters is also forbidden at the venue.
23. Only fresh or dried petal confetti is permitted at the venue, and this must be vacuumed or swept up as part of clearing. Metallic or paper confetti is not allowed.
24. A reduction in the number of attendees will not result in a refund. If numbers are reduced more than 45 days before the event, then every effort will be made to save variable costs such as catering etc. The agreed number of guests must not be exceeded.
25. We retain the rights to images taken on behalf of the client. Where the client has paid for photography, we give the client permission to use such images freely. The client gives us permission to use images or video taken during the event in our marketing and advertising materials.
26. This agreement is subject to Sottish law.
27. Prices quoted on our website and other marketing material are subject to change. We reserve the right to amend these terms and conditions at any time and you should therefore check them prior to making a booking. The terms and conditions applying to your booking will be those in place on the date that you make your booking.
